Service Commitment:
Digital Design NE will make reasonable efforts to provide a reliable and consistent service as outlined in the specification (“the Service”). However, Digital Design NE shall not be responsible for any data loss due to delays, non-deliveries, or service interruptions arising from factors outside of Digital Design NE’s control or due to errors or omissions on the part of the Customer. Digital Design NE specifically disclaims any warranties regarding the accuracy of third-party information accessed via the Service.
Digital Design NE will not be held liable for any indirect, financial, or consequential damages.
Digital Design NE’s liability in connection with the provision of the Service, whether contractual or otherwise, shall be limited to the value of the domain name(s) in question, in respect of any single event or series of related events.
Any dates or times provided for the completion of services or service components are business estimates only. Digital Design NE accepts no liability for delays or the consequences thereof.
Should customers violate these Terms and Conditions, Digital Design NE reserves the right to terminate the Service without a refund.
All fees paid are non-refundable, and once domain names are registered, they cannot be altered in name or extension without the costs involved in registering a new domain name with the applicable registry.
Service Contract:
From the second year onward, web hosting, ssl certificates and business emails will be billed annually.
The contract shall cover the entire period for which the Customer has paid, up to the expiration of the domain registration period, typically one year from the date of registration. Cancellations require 14 days’ written notice prior to the renewal date of any domain name or other products.
For customers who have paid by credit or debit card, we may process future renewal payments using the provided card details. We will inform you beforehand and you may revoke this authorisation at any time by notifying us in writing according to our cancellation terms.
Digital Design NE reserves the right to suspend or terminate the Service immediately if payment is not received from the Customer.
Occasionally, parts of the Digital Design NE network may be taken offline for maintenance or repairs. While we will provide as much notice as possible, Digital Design NE is not liable for unscheduled outages due to unforeseen circumstances, including but not limited to natural disasters, adverse weather, acts of government or telecommunications providers, or power failures.
Payment Terms:
If a split payment option is agreed upon (e.g., 50% upfront and 50% on completion), it is contingent on the artwork and content (including logos, desired text, and images) being provided within 30 days. As we incur full costs for the website hosting once the domain is registered, the remaining balance will become due if the requested materials are not provided within 30 days.
Improper Use and Liabilities:
The Customer agrees to use the Service solely for lawful purposes and must not use it to receive or transmit material that violates any law or regulation, is obscene, threatening, offensive, defamatory, breaches confidentiality, or infringes on intellectual property rights (including trademarks and copyright). This prohibition extends to spamming and bulk email activities, for which Digital Design NE reserves the right to take legal action.
Customers are responsible for taking appropriate measures to prevent the transmission of viruses through the Digital Design NE network and must not intentionally damage or interfere with the network.
The Customer must safeguard all usernames and passwords, ensuring third parties do not have access to them or store them in an easily accessible format. If a password becomes known to a third party, the Customer must inform Digital Design NE immediately by phone or email.
The Customer indemnifies Digital Design NE and its associated entities against any claims arising from the Customer’s use of the Service.
Customers must inform Digital Design NE of any legal action taken against them due to their use of the Service and agree that Digital Design NE will not be responsible for any resulting costs.
The Customer is also responsible for any costs incurred with telecommunications companies in connection with their use of the Service.
Digital Design NE cannot control the content of information exchanged via the internet, and the Customer acknowledges this.
The Customer agrees to adhere to acceptable use policies when connecting to other networks or systems through the internet.
Sub-Leasing/Resale Restrictions:
The Customer agrees not to reassign, resell, sublease, or transfer their account without following the correct procedures as stipulated by the relevant domain registry. Any violations will result in immediate service termination.
Service Agreement:
Domain transfers must be requested via email. No refunds will be issued for domain registrations.
Provided all information is accurate, domain transfer requests will be processed by Digital Design NE, assuming there are no outstanding payments from the Customer.
Customers wishing to transfer a domain to another Internet Service Provider (ISP) will be charged a transfer fee equal to the current annual hosting charge.
Domain Name Agreement:
Digital Design NE will register a domain on behalf of an individual or company, granting them exclusive use of the domain, provided all associated fees are paid and account balances are kept current.
By registering a domain name, the Customer agrees to indemnify Digital Design NE, its associated companies, and directors from any legal action arising from the use of the domain name. The Customer accepts full responsibility for any associated liabilities and costs.
Registered domains may be used for any legal, decent, and honest purposes on the internet. They must not breach internet laws or be used for immoral or pornographic purposes. By registering a domain name, the Customer confirms they have read and accepted the terms of the appropriate domain registry.
Digital Design NE is not responsible for indirect, incidental, or consequential losses, including loss of data, information, or income resulting from the use of the Service.
Digital Design NE reserves the right not to register or assign any domain name at its discretion.
Digital Design NE may delete or suspend any domain if payments are not received and reserves the right to charge administrative fees to reinstate any domain or service.
Changes to domain name registration or renewal rates, as well as modifications to services, will be announced on the Digital Design NE website or via communications to you at least 28 days prior to implementation.
Refund Policy:
Digital Design NE collects a 50% deposit before work begins, with the remaining 50% due upon completion. If a domain name has not been registered or final service design agreed upon, refunds will be issued for fees paid by the Customer.
If Digital Design NE fails to deliver the Service in functional capacity, a refund will be issued.
If a refund is granted, Digital Design NE reserves the right to reuse any design elements from the Service.
General Terms and Legal Jurisdiction:
Digital Design NE may perform routine system maintenance, such as backups, but does not guarantee their functionality. Customers are advised to implement their own backup measures as needed.
If illegal activity is suspected, Digital Design NE reserves the right to take any action recommended by legal advisors to protect the system.
This agreement is governed by the laws of the United Kingdom. Any disputes arising from or relating to the Service will be subject to the exclusive jurisdiction of the Central London County Courts or the London High Court.
You acknowledge that no joint venture, partnership, employment, or agency relationship exists between you and Digital Design NE as a result of your use of the Service. You agree not to represent yourself as an agent or employee of Digital Design NE.
Intellectual Property Rights:
All content (both text and images) provided by the Customer is their intellectual property. All content supplied by Digital Design NE, including website designs, is copyrighted to Digital Design NE. Digital Design NE reserves the right to place its banner on all websites it produces.
In the event of a customer cancelling their subscription or transferring away from Digital Design NE, any content owned by the customer will remain with them, but the website will be taken offline. Attempts to claim the work of Digital Design NE as your own will result in a breach of intellectual property rights and may lead to legal action.
